Terms of Service

These Terms of Service govern the use of the Seldora application (hereinafter: the "Service"), available at app.seldora.ai. By using the Service, you agree to the following terms.
1. Service Provider
The Service is operated by Adam Klukowski Enterprise, ul. Brzozowa 102, 05-152 Adamówek, NIP: 5792028889, REGON: 364103927, email: contact@seldora.ai.
2. Description of the Service
Seldora is an AI wellness chat application with astrological personalization. The Service enables conversations with an AI chatbot that incorporates the user's astrological data to personalize responses.
3. Subscription Plans and Pricing
The following subscription plans are available:
- Free Tier: Limited to 5 messages per day. No payment required. Available to all registered users.
- Monthly Plan: 69.99 PLN per month (including VAT). Unlimited messages. Billed monthly.
- Annual Plan: 587.92 PLN per year (including VAT), equivalent to approximately 49.00 PLN per month. Unlimited messages. Billed annually.
All prices are in Polish Zloty (PLN) and include applicable VAT. The operator reserves the right to change prices with at least 30 days' advance notice. Price changes do not affect the current billing period.
4. Billing and Payment
Payments are processed by Stripe, Inc. The operator does not store credit card numbers or payment credentials.
- Supported payment methods include BLIK, Przelewy24 (P24), credit/debit cards, and other methods available through Stripe.
- Subscriptions renew automatically at the end of each billing period unless cancelled before renewal.
- You can manage your subscription, payment methods, and billing history through the Stripe Customer Portal, accessible from the application settings.
- If a payment fails, the operator will attempt to charge the payment method again. If payment cannot be collected after reasonable attempts, your subscription may be downgraded to the Free Tier.
- By subscribing, you acknowledge and agree to automatic recurring billing.
5. Free Trials and Promotional Periods
- New users may receive a free trial upon registration, with full access to the Service.
- The operator may grant promotional free access periods to selected users at its discretion.
- No payment method is required to start a free trial or promotional period.
- Free trials and promotional periods cannot be paused, extended, or restarted.
- At the end of a free trial or promotional period, the user may choose a paid subscription plan or continue with the Free Tier (5 messages per day).
6. Cancellation, Refunds, and Right of Withdrawal
You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
EU Right of Withdrawal: Under the Polish Consumer Rights Act (Ustawa o prawach konsumenta) and EU Directive 2011/83/EU, you have the right to withdraw from a distance contract within 14 days of purchase without giving any reason. To exercise this right, send a clear statement to contact@seldora.ai. Upon valid withdrawal, a full refund will be issued within 14 days.
Waiver for digital content: If you explicitly consent to the immediate provision of digital content (i.e., access to the Service) before the 14-day withdrawal period expires, and acknowledge that doing so waives your right of withdrawal, the right of withdrawal no longer applies.
No pro-rata refunds are available outside the statutory withdrawal window.
7. Invitation and Referral Program
Users may invite others to the Service using a personal invitation link.
- For each invitee who becomes a paying subscriber, the inviter receives a 5% discount on their own subscription, up to a maximum of 30% (i.e., up to 6 paying invitees).
- Referral discounts are applied as fixed-amount PLN coupons to future billing cycles via Stripe.
- Referral discounts may be combined with other promotions, subject to a combined maximum discount cap of 40%.
- The operator reserves the right to modify, suspend, or discontinue the referral program at any time with reasonable notice.
Anti-abuse: Referral discounts are intended for genuine recommendations. The operator reserves the right to revoke discounts and suspend accounts involved in fraudulent, abusive, or artificial referral activity, including self-referrals, bulk invitations to non-genuine users, or any scheme designed to manipulate the program.
8. Medical Disclaimer
IMPORTANT: Seldora does NOT constitute medical, psychological, therapeutic, or any other professional advice.
Content generated by the Service is for informational and entertainment purposes only. In particular:
- The Service does not replace consultation with a physician, psychologist, psychiatrist, therapist, or any other qualified professional.
- The Service does not diagnose diseases, disorders, or physical or mental health conditions.
- The Service does not prescribe medications, therapies, or treatment plans.
- In case of a health crisis or life-threatening situation, you should immediately contact emergency services (112/911) or a doctor.
You bear full responsibility for any decisions made based on content generated by the Service.
9. AI-Generated Content
Chat responses are generated by an artificial intelligence model (Vertex AI Gemini). Accordingly:
- Content may contain inaccuracies, errors, or information inconsistent with fact.
- The operator does not guarantee the accuracy, completeness, or usefulness of generated content.
- Astrological content is for entertainment purposes and should not be used as a basis for life decisions.
- You bear full responsibility for any actions taken based on AI responses.
10. Age Requirement
The Service is intended solely for individuals aged 16 or older. By registering, you confirm that you meet this age requirement.
11. User Responsibilities
By using the Service, you agree to:
- Provide truthful and accurate information during registration and when completing your profile.
- Use the Service in compliance with applicable law and these Terms.
- Not engage in activities aimed at abusing the Service, including attempts to manipulate the AI system, overload the infrastructure, or gain unauthorized access.
- Not share your account with third parties.
- Not to circumvent message limits, subscription controls, invitation mechanisms, or other technical restrictions of the Service.
12. Data Ownership
You retain ownership of your personal data, chat content, and uploaded files. At any time you may:
- Export your data in a structured format (available in the app: Settings → Account).
- Delete your account along with all associated data (available in the app: Settings → Account).
13. Intellectual Property
All intellectual property rights in the Service, including the source code, visual design, logo, the name "Seldora," and user interface elements, belong to the operator. Use of the Service does not transfer any intellectual property rights to the user.
14. Email Communications
- The Service sends transactional emails necessary for the operation of your account, including: invitation notifications, trial and free period expiry reminders, subscription confirmations, payment receipts, and billing-related notices.
- You cannot opt out of transactional emails, as they are essential for the performance of the contract.
- The Service may also send occasional feedback or product update emails. You may unsubscribe from these at any time using the link provided in each email.
- We do not send marketing or promotional emails without your explicit consent.
15. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" basis, without any warranties, express or implied.
- The operator shall not be liable for direct, indirect, incidental, special, consequential, or moral damages arising from the use of or inability to use the Service.
- The operator shall not be liable for any actions or omissions by the user taken on the basis of AI-generated content.
- The operator shall not be liable for interruptions in Service availability, data loss, or technical issues arising from third-party infrastructure.
- The operator shall not be liable for any issues arising from the processing of payments by third-party payment processors, including Stripe. Any disputes related to payment processing should be directed to the respective payment processor.
- The operator shall not be liable for any loss of access or features resulting from the expiration of a free trial or promotional period.
16. Changes to Terms
The operator reserves the right to modify these Terms of Service at any time.
- Users will be notified of material changes at least 14 days in advance via email or an in-app notification.
- If you do not agree with the modified Terms, you have the right to cancel your subscription and delete your account before the changes take effect.
- Continued use of the Service after the effective date of the changes constitutes acceptance of the modified Terms.
17. Account Suspension and Termination
The operator reserves the right to suspend or terminate a user's account in the event of:
- Violation of these Terms of Service.
- Use of the Service in a manner inconsistent with applicable law.
- Activities that threaten the security or stability of the Service.
Non-payment: If a subscription payment fails and cannot be collected, the account will be downgraded to the Free Tier. Non-payment alone does not result in account deletion.
Abuse: In cases of severe or repeated abuse, the operator may permanently delete the user's account and all associated data.
You may delete your account at any time through the application settings.
18. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Republic of Poland. Any disputes arising from the use of the Service shall be resolved by the competent courts of the Republic of Poland.
For consumers within the European Union, you may also use the EU Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
